Compromise brings new plan to Burlington’s Appleby Mall development

Located at 5111 New St. in Burlington, the building plan follows several years of dispute between residents, the City and mall owners First Capital who had previously been seeking a larger development.

Ward 5 Councillor Paul Sharman, who has been involved in the process of working out a deal since it was first put forward in 2014, said the result involved compromise on all sides.

“The community got involved, that was the important thing,” Sharman said, “and because of that the applicant addressed every issue that was put in front of them. Is it the perfect solution for the residents? Probably not. But it is the best solution especially since the applicant has the right to build there.”

Originally the development called for two 17-story apartment buildings right up against Pinedale Ave. Now there will be three smaller buildings set back from the road and angled in such a way as to not cast shadows on other residences. Townhouse units will also make up part of the development, all of which will be built in the existing mall parking lot.

Representatives of First Capital were unavailable to comment and it is not known when construction would commence, although it could be several years down the road considering the company still has to go through the building plan process.

The deal to proceed with the project also puts an end to any issues between the City of Burlington and First Capital that were set to go before the Local Planning Appeal Tribunal.

Sharman said all parties should be satisfied coming away from the deal.

“Any development that goes through a processes where there was anxiety in the community about what was being proposed, to the point where there was good work done by all parties to the degree that compromises have been made that have been helpful to the final outcome; that’s a good thing,” Sharman said.
